HURON A request to remove a restricted covenant from one lot in the tree buffer zone between single-family homes on Cardinal Lane and multi-family buildings on Meadowlark Lane was withdrawn Monday after a next-door neighbor and another nearby neighbor objected.
The City Commission first considered a resolution a week ago, but delayed action to make sure neighbors were aware of the possibility that trees could be removed from what is known as Lot 50 located next to 1890 Cardinal Lane in the future to make room for a structure, such as a house or a garage.
Jeff and Jennifer Van Gerpen are purchasing Lot 50 and 1890 Cardinal Lane and asked for the covenant to be removed in the event they decide to have a house built on Lot 50, which faces 18th Street Southwest.
Last year, commissioners removed half of the covenant to allow other owners along Cardinal Lane to build fences or to have garden sheds in the trees in their back yards. But they retained the part of the covenant that provided for the tree belt.
Lot 50 is unique in that it is the only tree lot in the shelter belt that would have access to a public street.
Rich Bragg, the next-door neighbor, said he does not want to have another home adjacent to his back yard, and Steve Charron said something similar happened 20 years ago in the neighborhood and he doesnt want to see it occur again.
There is plenty of room to build a home on Lot 50 and meet setbacks.
Jeff Van Gerpen said its not their intention to put a house there, but they wanted the option to do so without having to come back for permission.
Mayor David McGirr said neighbors purchased their property with the expectation that the restricted covenant would be in place.
The parties were excused to another room to try and work out an agreement, but after about 20 minutes the commission was notified of the withdrawal of the request. No commission action was needed.
Approved a resolution for a quit claim deed for the transfer of property in the West Industrial Park from the city to Greater Huron Development Corporation. GHDC plans to build a speculative building on the site.
Accepted a $39,000 quote from Morris Inc. of Fort Pierre to crush stockpile concrete and asphalt. The stockpile is about 5,000 tons, much of it from curb and gutter removed from the projects to improve Ninth Street and Frank Avenue last year.
Renewed the annual Hunting Access and Habitat contract with the state Game, Fish & Parks Department for the walk-in hunting area at the former west landfill.
Approved a plat filed by the city for Ravine Park Lot 1 in an area zoned multiple-family residential. The plat is for city property involved in a lengthy railroad cleanup project.
Approved a special event on-sale alcoholic beverage license filed by the State Fair for an event May 4 at the Family Living Center.
Approved a special event on-sale alcoholic beverage license filed by Holy Trinity Catholic Parish for an event April 20 at the church.
Approved an $11,400 progress payment to Maguire Iron of Sioux Falls for work on the new East Industrial Park elevated water tower.
Approved a $12,051 progress payment to CB&I Inc. of Clive, Iowa, for work on the new north elevated water storage tank.
Accepted the annual loan renewal with the National Museum of the United States Air Force for the aircraft display at 76 15th St. N.W.
Set April 1 as the hearing date for a special event on-sale alcoholic beverage license filed by the city for an event at the Campus Center on April 10.
